Niche Weddings & Events Ltd. T/A Niche Flowers
Niche Flowers will provide all of the designs listed in your wedding flower proposal. Any other items added will be charged at an additional cost per item. The proposal will be re-issued to reflect any changes. Amendments must be made in writing by the Bride, Groom or (previously notified) appointed acting party.
By paying our £150 booking fee, you are agreeing to our terms and conditions, without exception.When booking Niche Flowers, you are agreeing to a minimum spend of £500 for your wedding to be delivered, plus a 15% delivery fee. For all spends under £500, we simply ask that you collect from us on the morning of the wedding. If you choose to reduce your flower order for delivery, it cannot be reduced below the minimum spend.
Your proposal is subject to change dependent of flower, foliage & plant availability at required time of purchase, two weeks before the wedding date. Your proposal’s prices are valid for one month from the date on the document. If no booking fee is received within this time, the prices may be subject to change.
Your final wedding price includes a complimentary wedding consultation lasting at least 45 minutes and a further 30 minutes final consultation, 6 weeks prior to your event. These must be made via prior appointment. Any further appointments are liable for an additional charge of £25 per hour. One onsite visit is free of charge if Niche Flowers have not worked at a venue before. If a site visit is required by the bride & groom at a venue that Niche Flowers has knowledge of, a charge of £25 per hour plus mileage will be chargeable.
Prices quoted will take into consideration a premium for weddings occurring over Valentine's Day, Mother's Day weekend and any public / bank holiday. NB: Flower prices increase considerably at these times due to demand, European national days of celebration & bank holidays can also a effect price and availability.
A non-refundable booking fee of £150 will be required to secure the services of Niche Flowers for bespoke wedding flower orders. (A non-refundable booking fee of £50 is required to secure Wedding Ceremony Garland orders.) If you are hiring items, this booking fee is refunded after the wedding, when all of the hired items have been returned safely in the condition provided.
Final payment for all flowers, foliage, sundries etc. must be made in 6 weeks in advance to the first wedding event (to the day). If final payment is not received on or before your balance due date, no flower order will be made to our suppliers until payment is received. In these circumstances we may not be able to help secure the varieties or sundries which you have specified for your wedding.
If payment has not been received by the wedding date, Niche Flowers reserves the right to cancel wedding flowers and is not obliged to compensation or a booking fee refund.
Niche Flowers cannot be held responsible for any failures of delivery of special orders by the wholesaler. We always do everything in our power to have your chosen blooms, but in the rare case of delivery failure we will do all we can to substitute the ordered flowers with the nearest varieties to the original order. Small variations in colour and size may occur.
Accepted Payment Methods: Online bank transfer or cash. Over £150 we cannot take payment via card machine.
Cancellation: All cancellations are required in writing. Should the wedding be cancelled within 14 days of the wedding, we are unfortunately unable to refund you due to the materials already being purchased. Up until 14 days prior to the wedding, the entire fee will be refunded, minus a 20% cancellation fee.
In the event the wedding date is either brought forward or postponed, Niche Flowers will honour the booking if the new date is available and Niche Flowers does not have another booking to fulfil. In the case of postponed weddings, Niche Flowers will hold your non- refundable booking fee until a new date has been set.
All flowers will be delivered to you in prime condition in water or suitable packaging for maximum shelf life. It is the responsibility of the receiver to make sure the flowers are kept in optimum conditions according to the florist's instructions. For items such as flower jewellery, hair accessories and ceremony wedding garlands (varmala, jaimala), these items do have a limited shelf life Niche Flowers. We do not recommend delivery or collection of items too far in advance. Niche Flowers cannot be held responsible for any failures in the flowers if these instructions have not been adhered to.
Please be aware that Niche Flowers cannot guarantee flowers to be open at the required time, such as lilies although we do our best to help them open in time for events, they are ultimately a living product that we are unable to control.
Niche Flowers requires a signature from yourself or an appointed person when you receive your flowers to confirm their delivery is of acceptable condition and that quantities are correct. Any queries must be raised within 1 hour of delivery.
Niche Flowers cannot take responsibility for any damage caused by additional modifications to the flowers carried out by anyone other than Niche Flowers staff.
Pinning of buttonholes/corsages on dresses and suits is done at the wearers own risk. This too applies for Hair flower accessories and ceremony garlands. Niche Flowers cannot be responsible for any snagging, staining or tearing to delicate materials by any pins or fastenings we supply.
Plant material can be harmful if consumed. For young bridesmaids and page boys please make them aware of the dangers of eating any of the elements in their flowers or buttonholes.
If any elements are being transported from one venue to another by anybody other than Niche Flowers staff or associates, you do so at your own risk.
On setting up a venue it is the responsibility of the Bride and Groom to make sure access and parking is available near the venue. Any parking charges may be chargeable.
To enjoy your day we will endeavour to be on site 1 hour before your event starts. It is vital to ensure that we have access at suitable times in order to do this smoothly.
If you choose not to have set up on the day it is the Bride and Groom's responsibility to organise suitable set up. Any breakages or damage to flowers or arrangements will be the Bride & Groom’s responsibility once they leave our premises.
Hire of artificial arrangements, table linen, lighting and additional items; services taken from us which can be set up in advance to the event will be offered in advance to the event date. From the point items are on the venue/premises in preparation for your event; during and after your event, the sole responsibility for the items will be of the Bride & Groom. You will be responsible for them until they are returned to us or collected by us. Please ensure that you have adequate Wedding Insurance to cover items. All items are to be returned in the same way we have delivered them. If any items are lost, broken, damaged, covered with excess wax or missing components; a charge for replacing these will be taken from the booking fee. For totals over £150, an invoice will be sent to the Bride & Groom for the items in question and the balance MUST be paid within 7 days.
If choosing the dry hire option for glassware or any other sundries and items where we do not supply set up, these must be returned within 3 working days, EMPTY and DRY, in their original packaging and in the condition in which they were received. It is the responsibility of the Bride & Groom to fund any postage or delivery charges. If items are lost, broken, damaged, covered with excess wax or missing, a charge for replacing the items will be taken from the booking fee. For totals over £150, an invoice will be sent to the Bride & Groom for the items in question and the balance MUST be paid within 7 days.
All hired items are the sole responsibility of the Bride & Groom. Niche Flowers can collect hired props if desired and this will be charged for in the proposal.
Niche Flowers cannot be held responsible of failure to deliver any order due to an act of God, pandemic, terrorism, crime, transport failure, extreme weather conditions (including snow and flooding) or denial of access to venues or religious sites. Niche Flowers recommends purchasing Wedding Insurance from a reputable company to protect your investment on your wedding day.
Trial designs can be made but these will be charged at the full value as stated on your proposal and must be paid for in advance, as with a general flower order.
Any mock bouquets made for you, along with any designs, sketches and photographs of our work we allow you to view and/or take away with you are subject to copyright laws (The Copyright, Designs and Patents Act 1988) and therefore you are not permitted to show them to, or allow them to be copied or used by any other florist or floral designer without the express consent of Niche Flowers. If you choose not to use Niche Flowers to provide your wedding flowers, any designs, sketches and photos must be returned without being copied.
Should you be unhappy with your flowers on the day of your wedding, you must contact Niche Flowers on 07714536337 within 1 hour of delivery so we can do whatever is necessary to rectify the problem. Any duration of time after the wedding day we are unable to refund any money as it is too late to resolve issues after the event has finished.
An emergency number for us is 07714536337 but this may only be used on the wedding day itself. All prior correspondences must be via hello@niche.wedding.
From 2021, Niche Flowers must be the sole flower supplier for weddings & events. We no longer work alongside DIY florals or in house flowers.
All our third-party recommendations are strictly made upon our working experience with such organisations in the past. Niche Flowers cannot in any way or form take responsibility for the actions of any third parties that we have recommended. All arrangements must be settled directly with each individual third party.
Confidentiality: The parties are aware that in the course of the performance of the services they will each have access to and be entrusted with Confidential Information of the other. Accordingly, they undertake in respect of Confidential Information of the other of them, that both during and after completion of the services booked, they will:
except as provided in this agreement, not divulge to any person whatever, or otherwise make use of (and will use its best endeavours to prevent the publication or disclosure of) any trade secret or Confidential Information;
not use the Confidential Information in any way for itself or any other person, except in a way that is authorised by this agreement or by the proper authority of the other of them;
not store, copy, or use the Confidential Information in any place or in any electronic form which may be accessible to any other person other than company employees.
keep all records of the Confidential Information in all media separate from other records;
keep all records only at the address as specified above (and in particular not to take records in electronic form to any other place);
make all relevant employees, agents and sub-contractors aware of the confidentiality of information and the provisions of this paragraph and to take all such reasonable steps as from time to time may be necessary to ensure compliance by those people with these provisions.
Limitation of liability: All implied conditions, warranties and terms are excluded from this agreement. If in any jurisdiction an implied condition, warranty or term cannot be excluded, then this sub paragraph will be deemed to be reduced in effect, only to the extent necessary to release that specific condition, warranty or term.
Niche Flowers shall not be liable to the Clients for any loss or expense which is: indirect or consequential loss; or economic loss or other loss of turnover, profits, business or goodwill; or loss of amenity represented by the Clients having no visual record of an event; loss or damage suffered by the Clients as a result of an action brought by a third party.
The above provisions apply even if such loss was reasonably foreseeable or Niche Flowers had been advised of the possibility of the Clients incurring it.
Except in the case of death or personal injury, the total liability of Niche Flowers under this agreement, shall not exceed the sum of £10,000. This applies whether an action is based on contract, tort or any other basis in law.
This paragraph (and any other paragraph which excludes or restricts the liability of Niche Flowers applies to Niche Flowers employees, subcontractors and agents (who may enforce this clause under the Contracts (Rights of Third Parties) Act 1999 as well as to Niche Flowers.
Niche Flowers agrees that before he permits any employee or contractor or other person to have access to any Confidential Information, he will enter into an agreement / contract of employment, binding any such person to the matters of confidentiality provided for in this paragraph.
Indemnity by the Bride and Groom: The couple agree to indemnify Niche Flowers against all loss, charges, damages and costs (including reasonable legal costs and regulatory and other fines or damages) arising directly or indirectly from the Clients’ failure to comply with the requirements of the Data Protection Act 2018 relating to obtaining permission of those present to be photographed or whose personal data is passed to Niche Flowers as if Niche Flowers had himself contracted with each of them individually.
When you place an order with us or make an inquiry, we gather certain information. This includes an address and contact details that we require to action your request. We will not disclose your information in any form whatsoever to any third party other than for the dispatch of your order.
